By creating an account or using the Cypha™ mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Inez Zimakowski trading as The Digital Llama (ABN 37 323 291 257) ("we", "us", "our").

1. NOT MEDICAL ADVICE (CRITICAL DISCLAIMER)

Cypha is an information and wellness tracking tool only.

• No Doctor-Patient Relationship: Use of the App does not create a doctor-patient or any other professional healthcare relationship.
• Informational Purposes Only: All content provided, including cycle insights, recipe suggestions, workout plans, and supplement information, is for general educational and wellness purposes. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
• Consult Your Doctor: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition (e.g., PCOS, endometriosis, ulcerative colitis, or pregnancy). Never disregard professional medical advice or delay seeking it because of something you have read in the App.
• Emergency Situations: The App is not a medical device and should not be used in medical emergencies. If you think you may have a medical emergency, call 000 (in Australia) or your local emergency services immediately.

2. ELIGIBILITY AND ACCOUNT

• Age: You must be at least 16 years of age to use this App.
• Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at contact@cypha.co of any unauthorized use of your account.

3. SUPPLEMENTS AND PHYSICAL ACTIVITY

• Personal Responsibility: You acknowledge that any lifestyle changes, including starting a new exercise program or taking dietary supplements suggested by the App, carry inherent risks.
• Interactions: Supplements can interact with prescription medications. You must check with a medical professional before starting any supplement tracked or suggested in the App.
• Physical Safety: If you experience pain, dizziness, or discomfort during any workout suggested by the App, you must stop immediately and consult a professional.

4. DATA AND PRIVACY

Your use of the App is also governed by our Privacy Policy, which explains how we handle your sensitive health information. By agreeing to these Terms, you also acknowledge the collection and storage of your data as described in that Policy.

5. INTELLECTUAL PROPERTY

We own or license all rights, title, and interest in the App, including software, text, graphics, logos, and "Cypha" branding. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. USER CONDUCT

You agree not to:

• Use the App for any illegal purpose.
• Attempt to "hack," reverse-engineer, or disrupt the App's infrastructure.
• Input false or misleading health data with the intent to manipulate the App's algorithms.

7. LIMITATION OF LIABILITY

• Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) that cannot be excluded.
• General Limitation: To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the App is limited to the total amount paid by you (if any) to use the App in the 12 months preceding the claim.
• No Indirect Loss: We are not liable for any indirect, incidental, or consequential damages, including loss of health data or personal injury resulting from your reliance on App content.

8. TERMINATION AND DELETION

• By You: You may stop using the App and delete your account at any time.
• By Us: We reserve the right to suspend or terminate your access if we suspect you have breached these Terms.

9. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
